The regional public organization "Historical-educational, human rights and charitable society «Moscow Memorial»", hereinafter referred to as «Beneficiary», in the person of the chairwoman Polivanova Alexandra Vladimirovna, acting on the basis of the Charter, hereby offers to individuals (hereinafter - «Benefactor»; the Beneficiary and the Benefactor are jointly called «Parties»), to enter into an Agreement of donation under the following conditions:


1. General provisions

1.1. This proposal is a public offer in accordance with article 437, paragraph 2 of the Civil Code of the Russian Federation.
1.2. The acceptance of this offer is the implementation by the Benefactor of the transfer of funds to the Beneficiary's current account as a donation for the maintenance of the organization and the conduct of the Benefactor's statutory activities. The acceptance of this offer by the Benefactor means that the latter has familiarized himself with and agrees with all the terms of this Donation Agreement.
1.3. The offer shall enter into force on the day following its publication on the website of the Beneficiary donate.memo.ru, hereinafter referred to as the Website.
1.4. The text of this offer may be changed by the Beneficiary without prior notice and shall be valid from the day following the day of its appearance on the Website.
1.5. The offer is valid until the day following the day of the appearance of the notice of cancellation of the Offer on the Website. The Beneficiary has the right to cancel the Offer at any time without providing reasons as to why.
1.6. The invalidity of one or more terms of the Offer shall not invalidate the other terms of the Offer.
1.7. Accepting the terms of this agreement, the Benefactor confirms the voluntary and non-refundable nature of the donation. The Benefactor confirms that they are a citizen of the Russian Federation. The Benefactor confirms that they are acting on his own behalf, that the funds transferred as a donation are not received from a foreign source.

2. Subject of the contract

2.1. Under this agreement, the Benefactor transfers his own funds to the Beneficiary's current account as a donation, and the Beneficiary accepts the donation for the purposes specified in paragraph 1.2. of thepresent offer.
2..2. The Benefactor's actions under this contract are considered a donation in accordance with Article 582 of the Civil Code of the Russian Federation.

3. The Beneficiary's activity

3.1. The objectives of the Beneficiary's activities under the Charter include support for programmes and projects designed to address social, charitable, cultural, educational, human rights and other social and useful tasks in the field of historical and legal education.
3.2. The activities of the beneficiary are not profit-making and direct all resources towards the achievement of the statutory objectives.

4. Contract formation

4.1 Only an individual may accept the Offer and thus enter into an Agreement with the Beneficiary.
4.2 The date of the acceptance of the Offer and the date of entering into an Agreement shall be the date on which the funds are credited to the bank account of the Beneficiary. The city of Moscow, Russian Federation shall be considered the place of contract formation. In accordance with article 434, paragraph 3, of the Civil Code of the Russian Federation, the contract is considered to be formed in writing.
4.3. The terms of the Agreement shall be determined by the Offer in the edition (taking into account the amendments and additions) in force (valid) on the day of execution of the payment order.

5. Donation

5.1. The Benefactor independently determines the sum of the donation and transfers it to the Beneficiary by any payment method specified on the Website under the terms of this Agreement.

6. The rights and duties of the parties

6.1 The Beneficiary undertakes to use the funds received from the Benefactor under this contract strictly in accordance with the current legislation of the Russian Federation and for the purposes specified in para. 1.2. of the present offer.
6.2 The Benefactor shall grant permission for the processing and storage of personal data used by the Beneficiary solely for the execution of said contract.
6.3 The Beneficiary undertakes not to disclose the personal and contact information of the Benefactor to third parties without their written consent, except in cases where this information is required by State bodies authorized to require such information.
6.4. The Beneficiary has the right to inform the Benefactor about the current programs via email.
6.5 The Beneficiary does not have any obligations towards the Benefactor other than those specified in this Agreement.

7. Miscellaneous

7.1 In the event of disputes and disagreements between the Parties under this Contract, they shall be resolved by negotiation as far as possible. In the event that it is not possible to settle the dispute by negotiation, disputes and disagreements may be settled in accordance with the current legislation of the Russian Federation in judicial instances at the location of the Beneficiary.
